1. Agreement to Terms
By accessing and using PT. Premium Fast Network ("Service", "Platform", "we", "us", or "our"), you ("User", "Customer", or "you") accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.
2. Service Description
PT. Premium Fast Network is a Kubernetes-as-a-Service platform designed for DevOps teams to deploy applications quickly without YAML complexity. Our service provides:
- Pre-configured Kubernetes clusters with monitoring and logging
- Auto-scaling capabilities and ingress management
- Application deployment tools and CI/CD pipeline integration
- Resource monitoring and performance analytics
- Team collaboration and access management features
- 24/7 support and maintenance for managed infrastructure
3. User Accounts and Authentication
To access the Service, you must register for an account with accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized access
- Ensuring your team members comply with these terms
- Maintaining accurate billing and contact information
4. Billing and Payment Terms
4.1 Subscription Plans
Our Service is offered through various subscription plans with different resource limits, features, and pricing. Current pricing is available on our website and may change with notice.
4.2 Payment Processing
Payments are processed monthly or annually in advance. You authorize us to charge your payment method for:
- Subscription fees according to your selected plan
- Usage-based charges for resources exceeding plan limits
- Additional services or support packages
- Applicable taxes and fees
4.3 Billing Cycle and Late Payments
Billing occurs at the beginning of each billing period. Failed payments may result in service suspension after a 7-day grace period. We may charge late fees for overdue accounts and reserve the right to terminate services for non-payment.
4.4 Refund Policy
Subscription fees are generally non-refundable. However, we may provide prorated refunds for service outages exceeding our SLA commitments or in cases of billing errors.
5. Data Responsibility and Management
5.1 Your Data Responsibilities
You retain ownership of your data and applications deployed on our platform. You are responsible for:
- Ensuring you have legal rights to all data you upload or process
- Implementing appropriate security measures for sensitive data
- Complying with applicable data protection laws (GDPR, CCPA, etc.)
- Regular backups of critical data and configurations
- Monitoring and managing your applications and workloads
- Ensuring your applications do not violate our Acceptable Use Policy
5.2 Our Data Handling
We implement industry-standard security measures to protect your data, including:
- Encryption at rest and in transit
- Regular security audits and penetration testing
- Access controls and audit logging
- Compliance with SOC 2 Type II standards
- Automated backups with point-in-time recovery
5.3 Data Portability and Deletion
You may export your data at any time using our provided tools. Upon account termination, we will retain your data for 30 days before permanent deletion, unless legally required to retain it longer.
6. Service Updates and Maintenance
6.1 Platform Updates
We regularly update our platform to improve performance, security, and functionality. Updates include:
- Security patches applied automatically with minimal downtime
- Feature updates rolled out gradually with user notification
- Kubernetes version upgrades with migration assistance
- Infrastructure improvements and optimizations
6.2 Maintenance Windows
Scheduled maintenance occurs during predefined windows, typically announced 72 hours in advance. Emergency maintenance may occur with minimal notice for security or stability issues.
6.3 Breaking Changes
For updates that may affect your applications, we provide at least 30 days notice and migration documentation. We offer support during transition periods to minimize disruption.
7. Service Level Agreement (SLA)
We commit to maintaining 99.9% uptime for our managed infrastructure, excluding scheduled maintenance. SLA credits may apply for verified downtime exceeding our commitments. Detailed SLA terms are available in our Service Level Agreement document.
8. Acceptable Use Policy
You agree not to use the Service for activities prohibited in our Acceptable Use Policy, including but not limited to:
- Illegal activities or violation of applicable laws and regulations
- Cryptocurrency mining, blockchain operations, or distributed computing without prior approval
- Unauthorized network scanning, penetration testing, or security research on third parties
- Creating, distributing, or hosting malware, ransomware, or engaging in phishing
- Excessive resource consumption that degrades service for other users
- Storing, processing, or transmitting content that violates intellectual property rights
- AI/ML model training or inference at scale without appropriate service tier
- Activities that circumvent usage limits, monitoring, or security controls
The complete Acceptable Use Policy is incorporated by reference and available at our website. Violations may result in immediate service suspension or termination.
9. Intellectual Property
The Service and its original content, features, and functionality remain the exclusive property of PT. Premium Fast Network. You retain rights to your applications and data. We grant you a limited license to use our Service according to these terms.
10. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy details how we collect, use, and protect your information. We comply with applicable data protection regulations and provide data processing agreements upon request.
11. Support and Service Levels
We provide technical support through multiple channels including email, chat, and documentation. Response times vary by subscription tier and issue severity. Premium support options are available for enterprise customers.
12. Warranties and Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PT. PREMIUM FAST NETWORK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PT. PREMIUM FAST NETWORK IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100 USD).
14. Indemnification
You agree to defend, indemnify, and hold PT. Premium Fast Network, its affiliates, officers, directors, employees, and agents harmless from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any third-party rights; or (iv) any content or data you submit, post, or transmit through the Service. This indemnification obligation will survive termination of these Terms.
15. Termination
Either party may terminate this agreement with 30 days written notice. We may suspend or terminate your account immediately for violation of these terms, non-payment, illegal activities, or threats to service security. Upon termination, you retain access to export your data for 30 days, after which data will be permanently deleted unless legally required to retain it.
16. Force Majeure
Neither party shall be liable for any failure or delay in performance due to events beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor strikes, government actions, internet outages, or pandemics. During such events, affected obligations shall be suspended until the event ceases.
17. Export Control and Sanctions
You acknowledge that the Service may be subject to export control laws and sanctions programs. You agree not to access or use the Service in violation of any applicable export control laws, economic sanctions, or embargo programs, including those administered by the United States, European Union, or Indonesia.
18. Assignment and Transfer
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. Any attempted assignment in violation of this section is void.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. The remaining provisions will continue to be valid and enforceable.
20. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict of law principles. Any disputes arising from these Terms shall first be addressed through good faith negotiations. If unresolved within 60 days, disputes will be resolved through binding arbitration in Jakarta, Indonesia, under the rules of the Indonesian Arbitration Board (BANI), unless prohibited by applicable law. Each party agrees to resolve disputes individually, not as part of a class action.
21. Changes to Terms
We may update these Terms to reflect changes in our Service, legal requirements, or business practices. Material changes will be communicated at least 30 days in advance through email and prominent platform notifications. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you disagree with changes, you may terminate your account.
22. Entire Agreement
These Terms, together with our Privacy Policy, Acceptable Use Policy, and Service Level Agreement, constitute the entire agreement between you and PT. Premium Fast Network regarding the Service. These Terms supersede all prior agreements, proposals, or representations, whether written or oral. Any conflicting terms in purchase orders or other documents are superseded by these Terms.
